Man is born, lives and dies like every living being. As the birth of a person has many legal consequences for the individual, family, society and the state, there are also some legal consequences of his death. Inheritance law is the field of law in which dispositions and testamentary dispositions are regulated. Although the majority of legal transactions regulate legal relations between individuals, the fact that death has consequences as a legal act has made it inevitable to regulate inheritance law specifically.

Inheritance law is regulated in the Turkish Civil Code in our country. Inheritance transactions related to the inheritance or transfer of property left by the legator are also documented through the civil registry systems established in notary publics as well as in civil courts. Sometimes the inheritor aims to save his property after his death by preparing a will or by issuing an inheritance contract with his heirs. A will is a testamentary disposition and is the act of leaving a certain property to one or more persons, effective after the death of a person. The will can be oral or written. With the death of the person, all of his assets (including his receivables and debts) pass to his legal heirs as a whole. In order to show who has rights on the inheritance, that is, who is the heir, an “inheritance certificate” is obtained from the court. The inheritance certificate is valid until proven otherwise.

If what is written in testamentary dispositions is not clear and intelligible, it is interpreted according to various interpretation rules and the will of the legator while writing the testament is revealed.
